The aim of the Aboriginal Languages and Cultures Victoria (ALCV) project is to provide resources to assist in the reclamation of Victorian Aboriginal Languages, and to implement the Victorian Essential Learning Standards (VELS) Aboriginal Languages, cultures and reclamation in Victorian schools: standards P-10 and protocols.

The ALCV website (ALCV Site) includes the following components:

  • a wiki for collaborative creation of articles related to Victorian Aboriginal Languages (the Wiki);
  • a discussion board for online discussion and notifications of relevant events (the Board); and
  • a Victorian Aboriginal Language data repository. 

These resources are for Victorian Aboriginal people and others, including linguists, teachers, and students undertaking Aboriginal Language programs in Victorian schools, to use in the reclamation and revival of Aboriginal Languages. 

Use of the ALCV Site or any of its components by a person under 18 years of age must only take place under the supervision of a responsible adult, eg. parent/guardian or teacher.

Warnings

Deceased Persons
Aboriginal and Torres Strait Islander Users are warned that the ALCV Site may contain the names, images and voices of deceased persons.

Language
Users are warned that the ALCV Site may contain words and descriptions that may be culturally sensitive and that might not normally be used in certain public or community contexts.   Terms and annotations which reflect the author's attitude or that of the period in which the item was written may be considered inappropriate today in some circumstances.

Acknowledgement

The ALCV Site contains material from the Monash University ARC Linkage Grant Project, ‘Reclamation of Victorian Indigenous Languages’, conducted by Dr Heather Bowe (Monash University, School of Languages, Cultures and Linguistics) and Associate Professor Kathy Lynch (University of the Sunshine Coast, ICT Research and Development) in collaboration with the following Linkage Partners: the Victorian Dept of Education and Early Childhood Development, the Victorian School of Languages, the Victorian Curriculum and Assessment Authority, the Victorian Aboriginal Corporation for Languages, the Federation of Aboriginal and Torres Strait Islander Languages, the Worawa Independent Aboriginal College, the Mirrimbeena Aboriginal Education Group Inc, and Cyberdreaming.

A. Summary

This is a summary of the Terms of Use for the ALCV site (Terms) set out in this document, but it is not a substitute for reading the terms.

  • You must comply with the Terms of Use for the ALCV Site.
  • You must only access and use the ALCV site for educational purposes
  • You must not search for, access, store or send any material which is pornographic, abusive, obscene, offensive, threatening or harassing
  • You must maintain the confidentiality of your password, and notify the VCAA if your password becomes known by another person.
  • The VCAA may suspend or terminate your access to the ALCV Site if you breach the Terms.
  • Use of the ALCV site is at your own risk.

B. General conditions for use of the ALCV Site

1. Introduction

You should read and understand these Terms before you access and use the ALCV site.  By accessing and using the ALCV Site or parts of the Site, you acknowledge that you have read and agree to be bound by these Terms without modification.  The VCAA reserves the right to amend these Terms from time to time at its sole discretion and without notice to users.   From time to time, additional Terms may be included on the ALCV Site, eg in relation to particular events or sections of the ALCV Site.

The ALCV Site is for personal, non-commercial, educational use only.

Your use of the ALCV Site is subject to all applicable local, state and federal laws.  By using the ALCV Site, you agree that you will not use it for any purpose that is unlawful or prohibited by these Terms.

Use of the ALCV Site is entirely at your own risk.  The VCAA does not warrant your access to the ALCV Site will be uninterrupted, timely or secure. 

Any violation of these Terms may result in suspension or termination of your access to the ALCV Site or parts of the Site, at the sole discretion of the VCAA and without notice or liability to you.

You acknowledge that all submissions, messages and postings to the ALCV Site or part of the Site (UserContributed Content)are or may be public and are not private communications.

User Contributed Content reflects the views of participants, and is not endorsed or approved by the VCAA, nor does it represent the views, opinions or policies of the VCAA.  The VCAA reserves the right but undertakes no duty, to review, edit, move or delete any Contributed Content at its sole discretion and without notice or liability to users.  Accordingly, User Contributed Content should not be regarded as having been reviewed or screened by the VCAA.  The VCAA is not liable in respect of User Contributed Content on the ALCV Site or for the actions of users of the ALCV Site.

2.  Rules of Conduct

You agree to use the Wiki and the Board only for the purposes of submitting Contributed Content that is appropriate and relevant to the ALCV Site.  You agree to treat other users with respect. You accept full responsibility for all your User Contributed Content. 

By way of example and not as a limitation, you agree that you will not:

  • use inappropriate, obscene, indecent or offensive language, swear or use punctuation characters or symbols to simulate swearing – the ALCV Site is designed to be accessed by people of all ages;
  • search for, access, store, send or submit any User Contributed Content that is defamatory, abusive, indecent, pornographic, threatening, harassing or hateful or otherwise unlawful;
  • submit any User Contributed Content that is encrypted, constitutes junk mail or unauthorised advertising, infringes anyone’s privacy or encourages conduct that would constitute a criminal offence, give rise to civil liability, or that otherwise violate any law, or engage in any other inappropriate conduct;
  • impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  • collect or store personal information about other users of the ALCV Site without their permission;
  • submit any User Contributed Content you do not own, or have not got the permission of the owner to submit;
  • delete the name or mark of the owner of any User Contributed Content;
  • falsify the origin or source of software or other material contained in User Contributed Content;
  • promote, endorse, advertise or offer to sell any goods or services whether for or on behalf of yourself, or any business or organisation with which you are associated;
  • conduct or forward surveys, contests, or chain letters;
  • make use of the ALCV Site or another User’s User Contributed Content for commercial purposes;
  • download any User Contributed Content of another user of the ALCV Site that you know, or reasonably should know, cannot be legally distributed in such manner, eg. where an author or contributor has requested no downloading;
  • ;
  • disrupt, modify or interfere with the ALCV Site, or interfere with others’ use of the ALCV Site, or tamper with any information or materials on the the ALCV Site, other than as permitted on the ALCV Wiki;
  • stalk or otherwise harass other users of the ALCV Site.

3. Copyright

Your User Contributed Content

When you submit User Contributed Content, you acknowledge and warrant that you have all necessary rights, including copyright, in the material.  If the copyright in material is owned by a third party, you must obtain their permission to submit it to the Site.  For this reason, it is preferable that you submit only material in which you own the copyright.  

By submitting any Contributed Content, you grant the VCAA a world-wide, royalty-free, perpetual, irrevocable, non-exclusive, transferable licence to use, reproduce, modify, adapt, translate, enhance or otherwise deal with that material for any purposes, with or without attribution.  You consent to the VCAA using the Contributed Content in a manner that, but for the consent, would otherwise infringe your moral rights under intellectual property law.

If you are a researcher, linguist, or non-Aboriginal user of the ALCV Site, please respect that Aboriginal Languages are owned by the land where the Language is spoken, with the Aboriginal community as caretakers of the Language.  Languages are not for use in the public domain without express permission of the relevant community. Please be aware of sensitivities associated with language and other cultural material when considering the submission of User Contributed Content containing Aboriginal Languages.  You must comply with any conditions upon which you have obtained access to that material, eg. any agreement you have made with the relevant Aboriginal community.

Please refer to the VCAA’s Copyright Statement in relation VCAA intellectual property and use of VCAA material on the ALCV Site.

4.  Privacy

Collection Statement

In order to register to use the Board, the VCAA collects personal information, including your name and email address.  This information is collected for the purpose of authenticating your participation and providing a return email address should the VCAA need to contact you.  Your email address is for VCAA internal use only and will not be disclosed to any third party unless it the VCAA is required by law or other regulation to do so. 

The username you supply when you register to use the Board will be used in the public presentation of your ideas and opinions (your User Contributed Content).  If you do not supply a username, or you supply one which VCAA moderators decide may allow you to be identified, the VCAA will delete your account and request you register again with a more appropriate username, which will ensure your anonymity.  You should be aware that any opinions you place on the Board will be placed in the public domain and may become a means for a third party to identify you. The provision of this information is voluntary but failure to provide your email address will result in you being unable to participate

You should not submit personal information about third parties to the ALCV Site.   When you provide the VCAA with information about other individuals, we rely on you to obtain their permission, and to make them aware that sch information has been or will be provided to the VCAA.

The VCAA does not sell personal information it collects.

You are able to request access to the personal information we hold about you, and to request that it be corrected.  Correspondence concerning access to your personal information should be addressed to:

5. Online safety

You must treat All User Contributed Content as public and not private communication.

Whenever you post information in publicly accessible places, such as chat rooms, message or bulletin boards, this information becomes available to anyone with access to the internet, may be found through search engines and can remain online indefinitely, forming your ‘digital footprint’.  This information can be collected and used by others. 

The VCAA recommends that you do not share personal information such as your address, telephone number or other contact details or photographs of yourself and/or others on the ALCV Site.  Personal information is any information from which your identity is apparent or can reasonably be ascertained, eg. by putting that information together with other information to identify you.  If you post personal information online that is accessible to the public, including other registered users of the ALCV Site, you may receive unsolicited messages from other parties in return. 

You should not post the personal information of third parties on the ALCV Site without their permission. 

Provision of personal information on the ALCV Site is entirely at your own risk.  The VCAA disclaims all liability in the event that you choose to share your personal information on the ALCV Site, or to persons you have met through the ALCV Site.

6.  Links and linking

Visiting third party links

The VCAA has not reviewed, is not responsible for and does not endorse the content of any sites linked to the ALCV Site.  Users visit third party sites at their own risk.

7. Disclaimer, indemnity and release

Use of the ALCV Site is at a user’s own risk.  Prospective users of the ALCV Site should also read the VCAA’s general website disclaimer: www.vcaa.vic.edu.au/Pages/footer/disclaimer.aspx

User Contributed Content reflects the views of participants, and is not endorsed or approved by the VCAA, nor does it represent the views, opinions or policies of the VCAA.  The VCAA reserves the right but undertakes no duty, to review, edit, move or delete any User Contributed Content at its sole discretion and without notice or liability to users.  Accordingly, User Contributed Content should not be regarded as having been reviewed or screened by the VCAA.  The VCAA is not liable in respect of User Contributed Content on the ALCV Site or for the actions of users of the ALCV Site.

The VCAA makes no representations about the content and suitability of the information on the ALCV Site for any purpose.    The VCAA does not warrant uninterrupted access to the ALCV Site.  The VCAA disclaims any responsibility for any interference with or damage to users’ computer systems which arises from or in connection with use of the ALCV Site and any linked website.  The onus is on users to check for and remove viruses or other malicious software.  The ALCV Site is provided “as is” without express or implied warranty.  Access to and use of the ALCV Site, and any reliance on information on the ALCV Site (including User Contributed Content) is at users’ own risk.

To fullest extent permitted by law, the VCAA disclaims any warranties with respect to any comments, opinions, statements, merchandise, information or User Contributed Content appearing on or linked to or from the ALCV Site, including all implied warranties as to merchantability and fitness, and assumes no liability, obligation or responsibility in relation to same.  

To the fullest extent permitted by law, the VCAA, its officers, employees, and agents shall not be liable for any loss or damage (including, without limitation special, indirect or consequential damages) which may be suffered or incurred or which may arise directly or indirectly in respect of Users’ access to or use of the ALCV site and its contents.

You agree to indemnify, release and hold harmless the VCAA, its officers, employees and agents in relation to and from any claim or action (including legal fees) arising out of or in relation to your use of the ALCV Site, including your submission of any User Contributed Content, your reliance on the Site and/or any User Contributed Content and/or third party links, and any breach of the Terms by you or any other user of the ALCV Site. 

8. Comments and Complaints

Users who believe that Contributed Content or any element of the ALCV Site is improper or illegal should notify vcaa.aboriginal.languages@edumail.vic.gov.au soon as possible, with details of the offending material.

C. Additional Terms of Use - Wiki

In addition to the general use conditions set out above, in using the Wiki, you acknowledge that you have read and agree to the additional conditions below.

The Wiki can be edited by members of the public.  Users do not have to be registered to edit the Wiki. No personal or identifying information is collected by the VCAA when a user edits the Wiki, only your anonymous Internet Protocol (IP) address.

The Wiki will be moderated, and the VCAA reserves the right to lock pages at its sole discretion and without notice or liability to Users.

Any inappropriate (sexually explicit, pornographic, defamatory, racist, sexist, homophobic, discriminatory) material will be removed. Material of an illegal nature will be reported to the local authorities.  Inappropriate material may be reported using the “report inappropriate use” link.

D. Additional Terms of Use – Discussion Board

The Discussion Board (Board) is provided for you to discuss issues related to Victorian Aboriginal Languages.

In addition to the general use conditions set out above, in using the Board, you acknowledge that you have read and agree to the additional conditions set out below.

9. Registration, Usernames, Passwords, Security

When you ask to register as a User of the board, you will be asked to provide your real name and contact details, including a genuine email address.  These details will not appear to any other User of the Board.  You should notify the VCAA if any of your registration information changes.

Consent is required for a person under the age of 18 to register to use the Board, and any subsequent use must be supervised by a parent/guardian or other responsible adult such as a teacher.

You will also be asked to nominate a username.  Please think carefully when choosing your username:

  • Usernames will appear on the Board and will be displayed publicly. Please choose a non-identifying alias rather than your real name for your own protection.
  • the VCAA will not accept business names, registered company names, email addresses or any other form of self-promotion, or any name considered inappropriate, as a username;
  • the VCAA reserves the right to refuse usernames at its sole discretion;
  • you must not intentionally use the name of another living person that is not your own;
  • you must not create multiple aliases (usernames);
  • VCAA reserves the right to suspend or delete your username or account, without notification at any time, and no correspondence will be entered into;
  • Usernames are not easily changed. If you wish to change your username, please contact vcaa.aboriginal.languages@edumail.vic.gov.au

Users are responsible for maintaining the confidentiality and security of their password, and for all User Contributed Content submitted with their username.  If you become aware that another person has access to or is using your username and/or password, you should contact the VCAA immediately by contacting vcaa.aboriginal.languages@edumail.vic.gov.au  VCAA is not liable for any loss you or a third party might suffer through your failure to keep your password secure.

10. Appropriate use

You agree to use the Board only to send and receive messages and material that is proper and related to the ALCV Site. 

The VCAA reserves the right but undertakes no duty, to review, edit, move or delete any Contributed Content at its sole discretion and without notice or liability to users.   From time to time, there may be material visible on the Board that violates these Terms and has not yet been removed or amended because it is yet to be drawn to our attention.  

The Board is provided by the VCAA for personal, non-commercial, educational use only.  Advertisements, chain letters, pyramid schemes, and solicitations are not permitted on the Board.

11. Suspension/Termination of Account

You may terminate your registration to use the Board at any time, by contacting vcaa.aboriginal.languages@edumail.vic.gov.au However, your User Contributed Content may still be available on the ALCV Site after your registration has been terminated.

The VCAA reserves the right to suspend and/or terminate User access to the Board temporarily or permanently at its sole discretion and without notice or liability to Users.  No correspondence will be entered into.

12. Online Safety

Users are reminded that User Contributed Content is public and not private communication.

Users and visitors must not post or exchange personal contact details using the Board. 

The VCAA recommends that you exercise care in sharing any personal information on the ALCV Site. Anyone under 18 must obtain the permission of a parent or guardian to share personal information about themselves on the ALCV site.  Personal information is any information from which your identity is apparent or can reasonably be ascertained. 

You must not post the personal information of third parties on the ALCV Site without their permission. 

Provision of personal information on the ALCV Site is entirely at your own risk.  The VCAA disclaims all liability in the event that you choose to share your personal information on the ALCV Site, or to persons you have met through the ALCV Site.
